Terms & Conditions

By accessing or using the Akaai ERP platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you ("User", "Institute", "Admin") and Akaai ERP ("Company", "we", "us", "our"). By registering an account, subscribing to a plan, or using any feature of the platform, you confirm that you have read, understood, and accepted these Terms.

Akaai ERP is a cloud-based institution management platform designed for educational institutes, coaching centres, and training academies. The platform provides the following core modules:

• Student lifecycle management (admissions, enrollment, attendance, leaves)
• Finance and fee management with EMI scheduling and Razorpay payment gateway integration
• Batch and program management with faculty assignment
• Curriculum builder with video, quiz, and assignment topics
• Coding platform with multi-language IDE, auto-judge, and problem library
• Analytics and reporting dashboards
• Role-based access control (admin, manager, faculty, counsellor, incharge, student)
• Communication tools including announcements and team chat
• AI assistant for student support (Enterprise plan)

We reserve the right to modify, suspend, or discontinue any feature or module at any time with reasonable notice.

To use the Service, you must register an institute account. By registering, you represent and warrant that:

• You are at least 18 years of age
• You have the legal authority to bind the institution you represent
• All registration information you provide is accurate, current, and complete
• You will maintain and update your information to keep it accurate
• You will keep your account credentials confidential and not share them with unauthorised parties

You are responsible for all activities that occur under your account, including actions by staff, faculty, counsellors, and students you add to the platform.

The Service is offered on a subscription basis. Current plans include Starter, Growth, and Enterprise — each unlocking progressively more features. All plan prices are listed in Indian Rupees (INR) and are exclusive of applicable taxes (GST). Subscription fees are charged in advance on a monthly or annual basis.

We reserve the right to change our pricing at any time. Existing subscribers will receive at least 30 days' advance notice before any price changes take effect. Failure to pay subscription fees may result in suspension or termination of your account.

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Harass, abuse, or harm other users, students, or staff members
• Upload or transmit viruses, malware, or any other harmful code
• Attempt to gain unauthorised access to any portion of the Service or its systems
• Scrape, crawl, or harvest data from the platform without written permission
• Use the platform for any fraudulent purpose or to misrepresent your institution
• Upload content that infringes intellectual property rights of any third party
• Resell, sublicence, or commercially exploit the Service without authorisation

We reserve the right to suspend or terminate any account that violates these terms without notice and without refund.

You retain full ownership of all data you input into the platform, including student records, financial data, program content, and communications ("Your Data"). We do not claim ownership over Your Data.

By using the Service, you grant us a limited, non-exclusive licence to store, process, and display Your Data solely for the purpose of providing the Service to you. All personal data is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

The Akaai ERP platform — including its software, design, logos, brand name, and all content created by us — is owned by Akaai ERP and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without express written consent.

The Service integrates with third-party services including Razorpay (payment processing). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the conduct or policies of third-party providers.

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to scheduled maintenance, unplanned outages, or force majeure events. We are not liable for any losses arising from service downtime.

To the maximum extent permitted by applicable law, Akaai ERP shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, data, goodwill, or business interruption.

Our total aggregate liability shall not exceed the amount paid by you to us in the three (3) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless Akaai ERP and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Either party may terminate the subscription at any time. You may cancel through your account settings. We may terminate your account immediately if you breach these Terms. Upon termination, your data is retained for 30 days, after which it is permanently deleted. See our Refund & Cancellation Policy for fee details.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India. We encourage resolution through good-faith negotiation before pursuing legal action. Contact us at legal@akaai.in with any concerns.

We may modify these Terms at any time. Registered users will be notified of material changes via email or in-app notification at least 14 days before changes take effect. Continued use of the Service after changes constitutes acceptance.
